THE ORDER FORM, OUR ORDER ACKNOWLEDGEMENT AND THESE CONDITIONS TOGETHER FORM OUR CONTRACT WITH YOU AND ARE BINDING ON YOU. PLEASE READ THEM CAREFULLY, CHECK YOU UNDERSTAND THEM AND THAT THEY ONLY CONTAIN TERMS YOU ARE PREPARED TO AGREE TO. FLOORING @ HOME (A trading division of Victoria Carpets Ltd) TRADING AS Beautifulflooringdirect.co.uk CONDITIONS OF SALE Terms & conditions The beautifulflooringdirect website is hosted and operated by Flooring @ Home (a division of Victoria Carpets Ltd). All purchase transactions are between the customer (you) and Flooring @ Home. 1. Descriptions, prices and product information We have taken care to describe and show items as accurately as possible. Despite this, slight variations in items may occur. We provide you with product information on www.bflooringdirect.co.uk (the "Website"). If there is anything which you do not understand, or if you wish to obtain further information, please contact Customer Services on info@bflooringdirect.co.uk You have a right to cancel your order for 48 hours after it has been placed and also, (unless your order is for carpet or sheet vinyl which has been cut to order), for a further 7 days after receipt of products ( please see section 6b) and to a refund when you cancel (please see section8 ) Every effort is made to ensure that prices shown for items are correct at the time when the item is added onto the Website. If, by mistake, we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at that price. If you decide not to order the item, we will give you a full refund on any amount already paid for that item in accordance with our refund policy in section 8 below. If we are unable to contact you, we will treat the order as cancelled. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of an item does not include the delivery charge, which will vary depending on the specific item(s) ordered and location. We will tell you what the delivery costs will be as soon as possible before conclusion of the contract between us. The rate applicable for the delivery charge will be calculated at the date you place your order. For more information on delivery arrangements see section 4 ‘Delivery’. 2. Availability We try to ensure that our suppliers always stock the full product range. If for any reason beyond our reasonable control we are unable to supply a particular item, we will not be liable to you except to ensure that you are not charged for that item. 3. Payment and acceptance If you buy an item from the Website the price applicable will be that provided at the time you place your order and you will be charged for an item at the time you place your order. After this time, you cannot amend your order (but please see our cancellation policy in section 6 below). Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch an item to you, at which point a contract will be made between us. At any point up until then we may decline to supply an item to you. We will provide reasons for declining to supply an item to you. If we decline to supply an item to you and you have already paid for it, we will give you a full refund of any amount already paid for that item in accordance with our refund policy in section 8 below. Where items are dispatched separately, our acceptance of the order in respect of each item takes place when that item is dispatched. 4. Delivery Delivery will be made to the address specified when you complete the order. Please note we only deliver to addresses within the UK mainland. We do our best to secure delivery to the UK mainland within 10 working days of receipt of your order. Deliveries will be made Monday - Friday between the hours of 7.00 a.m. and 6.00 p.m unless otherwise notified. Whilst we make every effort to deliver all your items within 10 working days of receipt of your order, we shall not be liable if we fail to do so in part or in full due to circumstances beyond our control. We shall contact you to let you know if we have any problems getting an item to you within that time. If you are not at home for a pre-arranged delivery then we reserve the right to charge you the cost of re-delivery. On delivery you will be required to conduct an item count and sign a Proof of Delivery which shall be conclusive evidence that you have received your order. By placing an order you are authorising us to accept signature from another person on your behalf if you need to sign for an item and you are not present at the time of delivery. Ownership of an item will not pass to you until we have delivered the item to you (either directly, or to your nominated store for collection). When an item is delivered, risk of damage to, or loss of the item passes to you. We shall have no further liability under the Contract if, for any reason, you fail to accept delivery of any of the products when they are ready for delivery, or we are unable to deliver your order on time due to health and safety risks. Limitations 5.1 Colour matching We cannot guarantee a perfect colour match where more than one width of carpet is involved and it is therefore recommended that wherever possible, carpets to be fitted together are ordered as one piece. 5.2 Shading & pile reversal All pile carpets, especially plain carpets supplied under this Contract are liable to shading, that is, to show light and dark patches arising from unequal crushing of the surface. No care on the part of the manufacturer can obviate these tendencies which are inherent in all pile fabrics and therefore, we are not liable for such patches. 5.3 Right of substitution We reserve the right to change the materials used in the manufacture of any flooring products sold by us and to take advantage of any technical developments, improvements or modifications which the Company considers desirable. We will use our best endeavours to ensure that information contained on the Website is up-to-date, but do not guarantee that such information will in all cases be identical with the goods sold under this Contract. Any substitute products provided will be of equivalent quality and price. You also have a right to cancel your order (unless your order is for carpet/sheet vinyl which has been cut to order) (please see section 6) and to a refund where you can cancel (please see section 8) 5.4 Shrinkage We do not accept any claim for shrinkage of floorcoverings supplied under this Contract unless the floorcovering has been secured to the floor by a qualified installer and even then, do not accept any liability if installed in an area subject to excessive moisture (e.g. bathrooms, toilets, kitchens). 5.5 In all cases We cannot accept complaints relating to: • (a). Shrinkage, where a floorcovering has been loose laid or exposed to damp or significant changes in atmospheric conditions; • (b).Shading and pile pressure bands, a tendency inherent in all pile fabrics, due to unequal pressure on the pile surface; • (c).Flattening which may occur to some extent in traffic lanes although regular vacuuming will help to allay this; • (d).Topical treatments applied by third parties not under our control after the manufacturing process which may damage or change the original nature and colour of the floorcovering; Please use the ‘contact us’ page of our Website for tips on installation and cleaning www.bflooringdirect.co.uk. • (e).The improper location, installation, use or cleaning of the floorcovering. • (f).Floorcoverings installed for longer than three months where the fault should have been immediately apparent on installation. 6. Cancellation of order for non faulty items (a) You may cancel your order for products ordered on the Website for up to 48 hours from when you place your order and we will then refund payment in accordance with our refund policy in section 8 below. (b) If you are acting as a Consumer you may also cancel your order for products ordered on the Website, at any time up to 7 working days following the day on which you receive such products, unless your order is for carpet/sheet vinyl which has been cut to order in which case you will not be entitled to cancel your order for such floorcovering under this clause 6b. If, at the time of cancellation the carpet/sheet vinyl has not yet been cut to your specific order requirements, we will accept your cancellation of the order and refund payment in accordance with our refund policy in section 8 below. If you want to cancel any Contract in accordance with clauses 6a or 6b, you must notify us in writing by e-mailing us at info@bflooringdirect.co.uk within the relevant timescale set out in this clause. If any products have already been sent by us to you, you must promptly arrange for and pay for the return of such products to us. Upon receipt of the request, BF Direct will issue a ‘returns note’ giving details of where the goods should be returned to. The goods must be unopened/packaged ‘as new’ and returned to the address given at your expense. Upon receipt of the goods, the supplier will check thoroughly and confirm to BF Direct if all items have been returned in an acceptable condition. Upon confirmation from the supplier, BF Direct will refund the value of the goods returned to the original card account that the sale payment was made on, in accordance with our refund policy in section 8 below. If you have opted for our ‘Collect from Store’ delivery option, on no account should you return goods to the store after the collection. The ‘Collection Point’ store has no responsibility for your transaction. The collect from store service is there to facilitate a more efficient method of getting your floorcovering to you. If you return products directly to a ‘Collection Point’ store, no refund will be given. Risk in the Products shall remain with you until we receive the products from you. This means you will be responsible for care of the products and you must bear the cost of any loss of and/or damage to the products before we receive them from you and so we suggest that you return products to us by courier or registered delivery. 7. Returns instructions for faulty items We hope that you will be happy with your purchase but should you wish to return a defective item please follow the instructions below. You agree to check the product on receipt and inform us of any defects within 72 hours of delivery. If there are any obvious defects to the product at the time of delivery you agree to note this on the Proof of Delivery slip. If, after, the packaging has been opened or a product has been fitted, you find a fault, the fault need to be reported to the web site via the submission form on the ‘contact us’ page. Upon receipt of a fully completed form, BF Direct will arrange for the manufacturer/supplier to inspect the goods. If the goods are faulty, the supplier will uplift the original goods and deliver replacement goods direct to you. Where the defect has been caused by measurement and/or installation and/or by the customer, Flooring @ Home shall not be liable. On no account must products be returned directly to ‘Collection Point’ Stores. If you return products directly to a ‘Collection Point’ Store, no refund will be given. If we agree to refund you for an item, please also send a copy of the invoice which accompanied delivery. Failure to show that you have purchased the item from us may result in no refund being given. We are not liable to you and do not accept any claims for losses you suffer during this time. If you would like further information about your legal rights please contact your local Trading Standards Department or Citizens Advice Bureau. 8. Refund policy If you are entitled to a refund, we will make a refund to the account originally charged for the purchase of the product. We will action all refunds within 10 working days of receipt of a cancelled item 9. Fitting We are not responsible for the fitting of any floorcoverings purchased via the bflooringdirect.co.uk web site. Beautiful Flooring Direct recommends our independent network of ‘Collection Point’ retailers who have qualified installers and who can arrange for your goods to be fitted. The fitting work will be carried out under a separate contract between you and the fitter(s) and the fitter(s) will take full responsibility for the quality of their work and service. Fitters undertake to carry out their work with reasonable skill and care, but even with the greatest care, home décor may be marked or scuffed during the fitting process. Wallpaper and new paintwork should be allowed to fully dry and harden before fitting. We are not liable for any acts or omissions of any fitters you employ, even if recommended by us. 10. Measurement The accuracy of measurement of the room dimensions in determining order quantity is your responsibility. We are not responsible for any mis-measurement which results in you ordering the wrong quantity of floorcovering for your room requirements. 11. Payments Flooring @ Home accepts Mastercard or Visa credit card, Maestro, Solo or Delta debit card. Your credit/debit card details will be encrypted by the Website to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. If there is a problem taking payment for all or part of your order we will contact you by email (or by telephone if you have not given us an email address). 12. Our responsibility to you If we are in breach of these Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order. Our products are for personal use only and our liability shall not in any event include business losses such as lost data, lost profits or business interruption. This paragraph 12 shall not limit or affect our liability resulting from any products sold being found to be unsafe or if something we do negligently causes death or personal injury. 13. General You may not transfer any of your rights under these Terms & Conditions to any other person. We may transfer our rights under these Terms & Conditions to another business where we reasonably believe your rights will not be affected. If you breach these Terms & Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms & Conditions. Except, as expressly set out in these Terms & Conditions, all use of your personal information will be made in accordance with our Privacy Policy. (a copy of which can be found at http://www.bflooringdirect.co.uk/privacy.aspx When ordering from the Website we accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection. These Terms & Conditions are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in England, Scotland or Wales. 14.
